Terms of service

These terms govern the use of this wedding photo-collection service by the couple who book it (the host) and by the guests who upload to it. They are written to be read, so they are short and in plain words. Please read them together with the privacy notice, which explains how personal data is handled and forms part of these terms.

The service

This service lets wedding guests upload photos and videos through a QR code into a shared gallery owned by the couple who booked it (the host). Guests need no account. We provide the technology that stores and shares that content — we do not select it, review it, or publish it, and the gallery belongs to the host, not to us.

Who is responsible for what

Personal-data law makes each of us responsible for different decisions, and we state our position on that rather than leaving it open: we and the couple are each a data controller, each for the decisions that are genuinely our own. Here is the division; the privacy notice sets out each part of it in detail.

  • We decide and carry out: how long media is kept, the record of each guest's consent, the erasure when the time comes, which companies process data for us, and the answer to any rights request a guest sends us.
  • The host decides: whose wedding it is, who is invited to upload, whether the gallery is opened to other guests or to a planner or photographer, what appears on the venue screen, and what they download and keep for themselves afterwards.
  • Whichever way the law characterises that split, a guest can exercise every right directly against us. We will never refuse a request by telling a guest to ask the couple instead.

The host's responsibilities

You are responsible for your event and your guests. You are responsible for ensuring that your own collection, use and disclosure of your guests' personal data complies with the law that applies to you — we do not decide that for you, and nothing on this page is legal advice. Your own responsibilities are at their clearest once you download the files to keep, or open the gallery to anyone beyond the couple. You control the gallery and can remove any item from it at any time.

Guest uploads, and what you are agreeing to

Uploading is how a guest gives consent, and it can be withdrawn at any time by deleting the files — the upload page does that on the same phone, with no account. That consent covers storing your files, showing them in this couple's gallery, showing them on the venue screen if the couple runs one, showing them to anyone the couple sends a view-only link to, and making the technical copies needed to do those things (thumbnails, video conversion, and download packages). It does not cover anything else. In particular, we do not:

  • use your photos or videos to market this service, or anything else;
  • use them to train artificial-intelligence models;
  • run face recognition on them, or tag anyone automatically;
  • sell them, or the data about them;
  • publish them ourselves, anywhere.

Who owns what, and the permission you give us

You keep ownership of every photo and video you upload; uploading gives us no ownership of it. The software, the website and the design of the service are ours. So that we can actually run the service, you give us permission to store, copy, resize, compress, convert, back up, package and transmit your files, for the sole purpose of providing the service to you and to the host and for no other purpose. That permission is not exclusive, nothing is paid or charged for it, we pass it on only to the companies listed as processors in the privacy notice, and it ends when the file is deleted.

The people in your photos

If you upload a photo, you confirm that you may share the images of the people in it. If you appear in a photo somebody else uploaded, you can ask for it to be taken down — write to us at the address below, or ask the couple; you do not have to go to the couple first. One limitation, stated plainly: we hold no name, face or contact detail for anyone, so we cannot find you in a gallery by searching for you. We will need enough detail to identify the file, and the couple — who can see the gallery — is usually the fastest route to it.

What must not be uploaded

Do not upload anything unlawful, and do not upload anything you have no right to share. We may rate-limit traffic, block automated access, remove content that breaches this section, and suspend or close the account of anyone who keeps breaching it. The following must never be uploaded:

  • content that infringes someone else's copyright or other rights;
  • sexual content involving children, which we erase and report without notice;
  • content that defames, harasses, threatens or impersonates a person;
  • malware, or anything designed to damage or disrupt a system;
  • automated collection or scraping, or attempts to reach galleries you were not invited to.

Reporting content

If something on this service is unlawful, infringes your rights, or should not be there, tell us at the address below. Say what the content is and where it is — which event, and as precisely as you can, which file. We look at every report and remove or erase content where it is warranted. Erasing is not the same as a host hiding an item: when we erase, the file and every copy we made of it are destroyed. We record every erasure we make, so that we can show what we did and when.

Plans and payment

Plans are priced by the number of guest devices that contribute, and every charge is shown to you in full before you pay. Payment is taken by our payment processor; we never see or store your card number. If a payment fails, is reversed, or is charged back, we may suspend the host's access to the gallery until it is settled — but see the next section, because we do not take that out on your guests.

When more guests contribute than your plan covers

We will never block or delay a guest's upload because of your plan limit, or because money is owed. If more guests contribute than your plan covers, their files are still stored, at full resolution, and nothing is lost. They are shown to you blurred and locked until the difference is paid after the event by PromptPay. We hold no card on file and take nothing automatically. If the difference is never paid, those files simply stay locked — we do not delete a guest's photos to collect a debt, and they are erased on the ordinary schedule in the next section, at the same time as everything else. All of this is disclosed at checkout.

How long media is kept, and what deletion does

An event's media is kept for 12 months, measured from the wedding date, and is then erased. The host can extend hosting in blocks of 12 months for ฿590; an extension can only push the date further out, never bring it closer. Erasure is real rather than a hiding of files: the files and every copy we made of them are destroyed, and what remains is a record that the erasure happened. A guest can delete their own files at any time before then, and a host can ask us to delete an entire event at any time. The privacy notice describes all of this in more detail.

Availability

We work to keep the service available, but we do not guarantee that it will be uninterrupted or error-free. We may suspend it for maintenance, for security, or where the law requires us to. We are not responsible for failures caused by things outside our reasonable control, including network and internet failures, the failure of a supplier we depend on, loss of power, or events such as natural disaster, civil disturbance or government action.

Our liability

The service is provided as it is. To the fullest extent the law allows, we are not liable for indirect or consequential loss, and our total liability to a host for any claim connected with an event is limited to the fees that host has actually paid us for that event. Nothing in these terms limits liability that cannot lawfully be limited — including liability for our own wilful misconduct or gross negligence, and any right you have as a consumer under Thai law that cannot be set aside by agreement. Photographs cannot be recreated, so please keep your own copy of anything you could not bear to lose.

If someone claims against us over your content

If a third party brings a claim against us because of content you uploaded that you had no right to upload, or because of unlawful use of the service by you, you agree to cover the reasonable costs and damages we actually incur as a result. This does not apply to anything caused by our own act, fault or breach of these terms, and we will tell you promptly about any claim we ask you to cover.

Age

You must be 20 or older to accept these terms and to book an event. Guests younger than that should upload only with the agreement of a parent or guardian, and a child under 10 should not upload at all, because the law treats that consent as their parent's to give. We have no way to verify anyone's age and we do not try to. If a child's photos were uploaded and should not have been, tell us or the host and they will be erased.

Changes to these terms

We may update these terms. Where a change materially affects you, we will surface it through the service rather than change this page quietly. The date at the top of this page is the date the current wording took effect.

For a question about these terms, a report about content, a copyright complaint, or a request about personal data, write to us directly. You do not have to go through the couple hosting the event, and we will not refuse a request by sending you to them.

Governing law

These terms are governed by the law of the Kingdom of Thailand, and the courts of Thailand have jurisdiction over any dispute arising out of them. If you are a consumer, this does not take away the protection of any law that applies to you and cannot be set aside by agreement.

The rest

These terms, together with the privacy notice, are the whole agreement between us about the service, and they replace anything said about it elsewhere. If any part of them turns out to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, we do not lose it.
